1Introduction
These Terms and Conditions govern every booking made with Travel Himalayas, including taxi services, tour packages, hotel bookings, treks, adventure activities and any other travel service we arrange. Please read them carefully before you book.
In these terms, “the Agency”, “we”, “us” and “our” refer to Travel Himalayas, an HP Government approved tour operator based in Manali, Himachal Pradesh, India (Tourism Dept. Registration No. 2-28/2007-MNL-TD-4012). “The Client”, “you” and “your” refer to the person making the booking and every traveller included in it. The website www.travelhimalayas.in is owned and operated by Travel Himalayas.
By making a booking with us, you confirm that you have read, understood and accepted these Terms and Conditions on behalf of yourself and all travellers in your booking.
2General Terms
All information on this website is based on the details available at the time of publication. Circumstances beyond our control may require us to change information before or after you book. Where we learn of a change in good time, we will inform you before or at the time of booking; otherwise, our tour manager or local representative will inform you on the spot.
We act as travel and holiday organisers only. We do not own, control or operate any airline, railway, coach, taxi, hotel or other facility mentioned on this website. Although we choose every part of your holiday with care, we cannot be held responsible for any mechanical fault, injury, death, loss or damage caused by the act or fault of an independent service provider — such as a hotel, airline, railway or transport operator — or its management or employees.
3Booking Contract
A contract between you and the Agency comes into existence only when we receive the advance payment specified for your tour or service. The balance must then be paid as set out in Section 4 – Booking & Payment.
If any payment is not received on time, we may cancel the booking. In that case the advance will be forfeited and the cancellation charges in Section 6 will apply.
We also reserve the right to cancel a confirmed booking before the tour begins without giving a reason. If we do so, we will refund your advance in full, without interest.
No one other than the Agency, in writing, has the authority to change, add to or waive any of these terms. If we need to change or alter any service, you may choose to:
- continue with the tour or service as changed; or
- accept an alternative tour or service that we offer.
In either case, you will not be entitled to a refund or to compensation for damages, additional expenses or consequential loss.
4Booking & Payment
The advance can be paid by cheque, cash or net banking into the Agency’s account. You can also use our Pay Online page. Your booking is confirmed only once the advance has been received.
5Preponing & Postponing
If you wish to bring forward (prepone) or put back (postpone) your tour dates, please send us your request in writing at least 7 days before the tour start date.
All date changes are subject to the availability of vehicles, hotels and other services on the new dates. Any difference in rates for the new dates will be payable by you.
6Amendments & Cancellations
If you wish to amend or cancel your booking for any reason — including death, accident, illness or failure to pay the balance — cancellation charges will apply. All cancellations must be sent to us in writing. The advance payment is non-refundable, and the following charges apply depending on when we receive your cancellation:
| When the cancellation is received | Cancellation charge |
|---|---|
| More than 30 days before departure | Advance forfeited |
| 15 to 30 days before departure | 50% of the total tour cost |
| 8 to 14 days before departure | 75% of the total tour cost |
| 7 days or less before departure | 100% of the total tour cost |
| No-show | No refund |
These charges apply to the main tour and to any optional tours published by the Agency. For air tickets, train tickets or any other third-party services booked on your behalf, the cancellation rules of the airline, railway or third party concerned will apply. In addition, we will charge our service fee for booking and cancelling such services.
Any amendment to your original booking must be sent to us in writing and will be processed only after we receive it. If an amendment results in the cancellation of one or more services, the charges above will apply to those services. For refund timelines and methods, please see our Refund & Cancellation Policy.
Transfer between tours
Moving from one tour to another is treated as a cancellation of the original booking, and the cancellation charges above will apply. The new tour will be treated as a fresh booking.
7Itinerary Changes
For the comfort and convenience of travellers, we may occasionally reverse the order of an itinerary or make minor changes to it. Wherever possible, we will let you know before or during the tour.
If you miss any part of the sightseeing because of your own delay, no refund can be claimed for the part missed.
8Hotels & Accommodation
Hotel names mentioned in our itineraries and quotations are indicative. If a named hotel is not available due to unavoidable circumstances, we will provide accommodation of a similar category, and no refund will be payable for the change.
- Standard hotel check-in and check-out times apply. Early check-in or late check-out is subject to availability and may be charged by the hotel.
- We are not responsible for any loss of property, injury or loss of life at the hotel.
- Any damage caused to hotel rooms or property during your stay must be paid for by you directly. The Agency will not be liable for such damage.
9Transport & Luggage
Depending on group size and availability, we use vehicles such as deluxe 2×2 coaches, Tempo Travellers, Tata Wingers, Scorpios, Toyota Innova Crystas or similar. The vehicle provided will be suitable for the size of your group.
- Seats in coaches are allotted on a first-come, first-served basis, according to the date of booking.
- Vehicles provided for transfers and sightseeing are for group use as per the itinerary only, and are not at your disposal for personal or additional use.
- Drivers must follow rules on maximum driving hours and rest periods. Please keep to the daily schedule given to you. If any sightseeing is missed because of a delay on your part, no refund will be given.
- Your luggage and personal belongings remain your own responsibility at all times. The Agency is not responsible for theft or loss of any items from vehicles.
10Meals
Where meals are included, menus for breakfast, lunch and dinner are fixed and served as mentioned in each tour itinerary. We are unable to arrange special meals or guarantee special diets, and we may change meal arrangements if circumstances require it.
If you miss an included meal — for example, by getting up late or returning late on your own — no claim can be made for that meal.
11Health, Safety & Liability
Travel in the Himalayas involves high altitudes, long drives, changing weather and mountain roads. Please make sure you are medically fit to travel and carry any medicines you may need.
The Agency shall not be liable to you or to any other person for:
- any death, personal injury, illness, accident, loss, delay, discomfort, increased expense, consequential loss or damage, or any misadventure, however caused;
- any act, omission, fault or negligence of an independent service provider, or its employees, engaged in providing accommodation, food, transport or any other service to you; or
- the temporary or permanent loss of, or damage to, luggage or personal belongings, however caused.
The words “however caused” include negligence on the part of any person. In any event, the Agency’s total liability shall not exceed the total amount paid, or agreed to be paid, for the tour, and shall not include any consequential loss or additional expense.
12Travel Insurance
Our tour prices do not include travel insurance, and Travel Himalayas does not sell any insurance policy. We strongly recommend that you arrange suitable travel insurance before your trip. Any insurance claim must be settled directly between you and your insurance company.
13Force Majeure
Events beyond our control may force us to change, shorten or extend an itinerary. Such events include, but are not limited to: acts of God, exceptionally bad weather, landslides, road closures, earthquakes, floods, fire, war (declared or undeclared), invasion, rebellion, riots, civil unrest, strikes, epidemics, nuclear incidents, and any action or order of a government, government agency, court or tribunal.
Any additional expenses arising from such events must be borne by the travellers. No refund will be given for services that cannot be provided because of natural calamities, weather or road conditions.
14Inclusions & Exclusions
Only the services listed as included in your quotation or itinerary are part of the tour price. Unless specifically mentioned, the following are not included:
- Lunches and any meals not stated in the itinerary.
- Additional or personal use of the vehicle.
- Extra excursions or sightseeing not specified in the itinerary.
- Entry tickets, camera fees and guide charges.
- Incidental expenses such as tips, laundry, telephone calls and room service.
- Applicable taxes, unless included in the quoted price.
Please also note
- It is mandatory for every traveller to carry a valid photo ID card throughout the tour.
- If a hotel is not available, accommodation of a similar category will be provided.
- No refund will be given for services missed because of natural calamities, weather, road conditions or the physical fitness of a traveller.
15Complaints & Claims
If you are unhappy with any service provided by a hotel, transport operator or other independent service provider, please inform that provider in writing straight away and give a copy to our tour manager or representative. This allows the matter to be resolved promptly or taken up to improve future services.
16Governing Law & Jurisdiction
These Terms and Conditions are governed by the laws of India, and all tours are subject to the applicable rules and regulations of the Government of India and the Reserve Bank of India.
All complaints, claims, suits or disputes of any nature relating to our tours, services or third-party products shall be subject to the exclusive jurisdiction of the courts and tribunals at Manali, Himachal Pradesh, India.
17Acceptance of Terms
Once you make a booking — by signing the booking form or by paying the advance — these Terms and Conditions become binding on both you and the Agency and form the sole basis of the agreement between us. They replace all previous communication, whether oral or written, regarding the terms of the tour and its services.
We may update these Terms and Conditions from time to time. The version published on this page on the date of your booking will apply to that booking.
